The EEOC has become more aggressive in processing discrimination and retaliation claims under Title VII, the Americans with Disabilities Act (ADA) and the Age Discrimination in Employment Act. The ADA has been amended to expand the number of employees and job applicants who qualify for the protections of that law. Claims against employers for retaliating against employees for asserting rights under these statutes have become the most frequently filed EEOC claims. It has thus become increasingly important for employers to know how to comply with these laws in order to minimize their exposure to liability.
