Combustible Dust in the Workplace: OSHA Enforcement and Rulemaking Proceedings

On October 17, 2007, the federal Occupational Safety and Health Administration implemented a Combustible Dust National Emphasis Program, CPL 03-00-006.  On March 11, 2008, OSHA implemented a revised Combustible Dust NEP, CPL 03-00-008. 

In response to the Combustible Dust NEP, OSHA has issued almost four thousand citation items to the regulated community alleging various combustible dust-related hazards in the workplace.  On October 21, 2009, OSHA issued an Advanced Notice of Proposed Rulemaking for a comprehensive combustible dust standard. 

This session will examine OSHA's authority to promulgate a comprehensive combustible dust standard, challenges with promulgating a comprehensive combustible dust standard, and enforcement of existing OSHA standards regarding combustible-dust related hazards in the workplace.

Michael T. Taylor, J.D., Arent Fox LLP, Washington, DC

Mike focuses on all aspects of occupational safety and health law. He represents employers and trade associations in a wide range of industries, including, but not limited to, the health care, chemical and petrochemical, electric utility, manufacturing, construction, and food services industries. He represents employers and trade associations during federal and state enforcement litigation and rulemaking proceedings. He also provides compliance counseling, catastrophe management, safety and health audits, and due diligence reviews for clients. He is also well-versed in all aspects of the National Labor Relations Act.

Before joining Arent Fox, Mike served as Acting General Counsel of the Occupational Safety and Health Review Commission, the federal administrative agency in charge of adjudicating safety and health workplace disputes between OSHA and private industry. He also served as Chief Legal Counsel and Special Advisor to W. Scott Railton, Chairman of the Occupational Safety and Health Review Commission.
