Architect as Leader: Leading the Discussion on Dispute Resolution with Clients & Consultants 1704

The current version of the AIA-format Owner/Architect Agreement, issued in 2007, no longer mandates binding arbitration as the default method for resolving disputes, should mediation fail. And although this version still requires the parties to attempt to mediate their disputes before going to arbitration, or court, it now gives the parties the choice of "arbitration", "litigation", or "other" . ( If the parties have decided on their own form of dispute resolution, they may describe it in the blank next to "other".) However, the Agreement now states that if none of the choices are taken, then disputes will be settled thru litigation, as required by law.

This interactive Round-Table discussion has been designed to assist Architects who must now be prepared to discuss the pros and cons of very different dispute resolution methods with their clients, before finalizing their Agreements.

Our first session on passive design focused on the benefits of climatic design response, session 2 will expand the discussion to include the active components of HVAC system design. We will discuss how systems are selected, zoned, coordinated, and developed throughout early design and how and an integrated project approach can optimize overall building performance.

It honors architects who have made a significant contribution to architecture and society on a national level. Integration 201 Series
The Integration Series brings together architects, engineers, owners and builders to promote a deeper understanding of processes and systems to better design and operate high-performance buildings. While the 101 series focused on integration fundamentals, the 201 series will delve into the methodology and decision making of energy and water efficient systems and elaborate how they are integrated into specific projects. Each Integration session will consist of four members of a project team involved in the design and installation of a specific high performance system on a project. Panelists will discuss the decision making and analysis process, design synergies and impacts, and issues related to installation and operations of the system. Following the initial 30 minute panel, attendees will be invited to participate in an informal question and discussion period.
